TERMS OF SERVICE

Welcome to Accentify.

These Terms of Service ("Terms") govern your use of Accentify's websites, mobile applications, learning content, AI-powered features, coaching features and other products and services that link to these Terms (collectively, the "Services").

Please read these Terms carefully. By creating an Accentify account, accessing or using the Services, purchasing a paid Accentify product, or otherwise indicating that you accept these Terms, you agree to be bound by them.

If you do not agree to these Terms, you should not use the Services.

Certain Accentify features, purchases, promotions or services may be subject to additional terms presented to you at the relevant time ("Additional Terms"). These may include, for example, Accentify Examination Terms or terms applying to a particular promotion. If Additional Terms conflict with these Terms, the Additional Terms will take priority in relation to the specific feature, purchase or service they govern.

Our Privacy Policy explains how we collect, use, store and share personal information and should be read alongside these Terms.

1. ABOUT ACCENTIFY

Accentify provides accent-learning and speech-training tools, including structured courses, voice practice, AI-supported analysis and feedback, progress and gamification features, professional accent-coach services and other learning experiences.

The features available through Accentify may change as the Services develop.

2. WHO MAY USE ACCENTIFY

You may use Accentify only if you are legally permitted to do so under the laws that apply to you.

Where applicable law requires the involvement, permission or authorisation of a parent or guardian before a person can enter into these Terms or use a particular feature, that requirement must be satisfied.

Some Accentify features may have additional age-related restrictions, safeguards or eligibility requirements. Where this applies, we may explain these requirements when you access the relevant feature.

Our approach to children's personal information is described further in our Privacy Policy.

3. ACCOUNTS AND USERNAMES

3.1 Your account

Some Accentify features require an account.

You must provide information that is reasonably accurate and keep relevant account information up to date.

You are responsible for protecting your account credentials and for activity carried out through your account unless that activity results from circumstances for which Accentify is responsible.

You should contact us promptly if you believe your account has been accessed or used without your permission.

You must not sell, transfer or provide another person with access to your Accentify account where doing so would breach these Terms or circumvent restrictions applying to the Services.

3.2 Usernames

Accentify may allow you to choose a username.

Your username may be visible to other users where Accentify includes public or shared features.

You must not use a username that:

  • impersonates another person without permission;

  • falsely suggests that you are Accentify, an Accentify employee, coach, administrator or official representative;

  • infringes another person's intellectual property or other rights;

  • contains unlawful, abusive, hateful, sexually explicit or seriously offensive material;

  • facilitates fraud, deception or harassment;

  • is intended to mislead other users; or

  • otherwise breaches these Terms.

We may reject, reserve, filter, remove or require the change of a username where reasonably necessary to protect Accentify, another user, a third party or the integrity of the Services.

Certain names may be unavailable or reserved even where another user is not currently using them.

4. THE ACCENTIFY SERVICE

Accentify may provide features including:

  • accent courses and lessons;

  • listening, pronunciation and speech exercises;

  • voice recording and analysis;

  • AI-powered feedback and coaching;

  • learning progress and statistics;

  • streaks, achievements, lives, Gold and other gamification features;

  • professional accent-coach feedback;

  • Hire A Coach and other coaching features;

  • usernames, profiles and user-generated content features;

  • Tip of the Day and similar learning content;

  • comments;

  • advertisements and rewarded advertisements;

  • examinations and assessments;

  • promotions and referral features; and

  • other learning, coaching or community features introduced over time.

Not every feature is available to every user, on every device, in every country, on every platform or under every subscription plan.

Some features may be experimental, limited, beta, promotional or temporary.

Unless we specifically promise otherwise, the existence of a feature at one point in time does not mean that Accentify is required to offer that feature permanently.

How we may change the Services, including paid Services, is explained in Section 16.

5. AI-POWERED FEATURES AND TIFY

Accentify uses artificial intelligence, machine learning, speech-processing technologies and other automated systems in parts of the Services.

These features may include Tify and other systems used for functions such as:

  • analysing pronunciation;

  • analysing accent characteristics;

  • estimating similarity to a target accent;

  • generating accent or pronunciation scores;

  • generating learning recommendations;

  • providing feedback;

  • creating or adapting learning content;

  • supporting speech-based interactions; and

  • providing AI-powered coaching or conversations.

5.1 AI output can be imperfect

Artificial intelligence and automated speech-analysis systems can make mistakes.

Scores, classifications, recommendations, explanations and other AI-generated outputs may sometimes be inaccurate, incomplete, inconsistent or inappropriate.

An Accentify score or AI assessment is an educational tool. It should not be treated as an infallible or scientifically absolute determination of how a person speaks.

Accents also vary naturally between speakers, regions, communities, generations and contexts. Accentify's systems may therefore interpret speech differently from a human coach or another speech-analysis system.

5.2 Use of AI feedback

You should use reasonable judgement when relying on AI-generated feedback.

Accentify's AI features are provided for learning, practice and coaching purposes. They are not intended to replace medical advice, speech and language therapy, legal advice or another regulated professional service.

Unless Accentify expressly states otherwise, AI-generated scores or feedback do not constitute a formal Accentify examination result or certification decision.

5.3 Third-party AI and speech technology

Accentify may use its own technology and technology supplied by third-party AI, speech-processing, cloud or infrastructure providers.

Personal information processed in connection with these systems is handled as described in our Privacy Policy.

5.4 Your use of AI features

You must not use Accentify's AI features:

  • for unlawful, fraudulent or abusive purposes;

  • to interfere with or compromise Accentify's systems or safety mechanisms;

  • to generate or distribute content that breaches these Terms; or

  • in a way that violates another person's rights.

You are responsible for how you use or share AI-generated outputs.

AI-generated outputs may not be unique. Other users may receive similar or identical outputs.

Except where otherwise stated, Accentify does not claim ownership merely because content was generated for you by an Accentify AI feature. However, the legal ability to own or protect AI-generated material may vary depending on the circumstances and applicable law.

6. VOICE RECORDINGS AND OTHER USER CONTENT

6.1 Your Content

Accentify may allow you to submit, upload, record, create or post content ("User Content").

User Content may include:

  • voice recordings;

  • audio;

  • profile pictures;

  • profile information;

  • usernames;

  • profile biographies;

  • comments;

  • scripts or text supplied for coaching;

  • messages or communications submitted through relevant features;

  • feedback provided to Accentify; and

  • other material you choose to submit.

You retain ownership of rights you already hold in your User Content.

6.2 Permission needed to use your content within Accentify

To provide and operate the Services, you give Accentify a non-exclusive, worldwide and royalty-free licence to host, store, reproduce, process, transmit, analyse, display and otherwise use your User Content to the extent reasonably necessary to:

  • operate the feature through which you submitted it;

  • provide learning, assessment, feedback or coaching you request;

  • process and analyse recordings and speech;

  • make User Content available to another user or approved professional where you choose a feature requiring this;

  • display content you choose to post in a public or shared part of Accentify;

  • moderate, secure and protect the Services;

  • investigate misuse or enforce these Terms; and

  • comply with legal obligations.

Where necessary to provide the Services, this licence includes allowing Accentify's service providers and approved professionals to handle the relevant content on Accentify's behalf.

This licence does not transfer ownership of your User Content to Accentify.

This licence concerns the rights needed to use the content itself. Our collection, use, retention and deletion of personal information contained in User Content is governed separately by our Privacy Policy.

The licence for particular User Content ends when that content is deleted from the Services, except to the limited extent that continued use or retention is reasonably necessary for legal compliance, dispute resolution, enforcement of legal rights or another purpose permitted by applicable law.

6.3 Voice recordings

Where you submit voice recordings, Accentify may process them for accent analysis, pronunciation analysis, AI feedback, coaching and other purposes described in our Privacy Policy.

Where you choose a feature involving professional human feedback, relevant recordings and associated information may be made available to an Accentify Approved Accent Coach or another approved professional who needs access to provide that service.

Accentify's use of voice recordings for AI and machine-learning development is described in our Privacy Policy.

We will not use your voice recording as advertising or promotional creative featuring you without separate permission.

6.4 Content visible to other users

If you choose to post User Content in an area that is visible to other Accentify users, you give Accentify permission to make that content available through the Services.

You understand that content posted in a public or shared part of Accentify may be seen by other users together with information such as your username or profile information where the feature is designed to display it.

Do not post information publicly that you do not want other users to see.

6.5 Your responsibility for User Content

You must have the necessary rights and permissions to submit User Content.

You must not upload or submit another person's recording, image, confidential material, copyrighted work or other protected content unless you have the right to do so.

You are responsible for User Content you submit and for ensuring that your submission does not unlawfully infringe another person's privacy, intellectual property or other rights.

6.6 Product feedback and suggestions

If you voluntarily provide Accentify with suggestions, ideas or feedback about the Services, we may use that feedback to develop and improve Accentify without being required to compensate you.

This does not give Accentify additional rights over personal information contained in that feedback, which remains subject to our Privacy Policy.

7. COMMENTS AND OTHER USER-GENERATED CONTENT

Accentify may allow eligible users to post comments or other content that can be seen by other users.

For example, Accentify may allow users to leave comments on certain Tip of the Day content.

Availability, eligibility and functionality of comments may change over time.

7.1 Rules for comments

You must not post content that:

  • is illegal;

  • threatens, harasses, bullies or abuses another person;

  • promotes hatred, discrimination or violence against a person or group;

  • is sexually explicit or pornographic;

  • sexually exploits or endangers children;

  • encourages self-harm, serious violence or other dangerous conduct;

  • contains scams, fraud, phishing or deceptive promotions;

  • contains malicious links, malware or harmful code;

  • infringes intellectual property, privacy or other rights;

  • publishes another person's private or personal information without appropriate permission;

  • impersonates another person;

  • constitutes spam or repetitive promotional content;

  • is deliberately intended to disrupt or degrade the experience of other users; or

  • otherwise breaches these Terms.

7.2 Moderation

Accentify may use automated filters, moderation systems and human review to identify or prevent prohibited content.

We may review, refuse, hide or remove User Content before or after it appears within the Services.

We may take proportionate action against an account where User Content breaches these Terms, including warning, restricting, suspending or terminating the account.

Where Accentify provides reporting tools, you may use them to report content that you believe breaches these Terms.

You may also contact us at whatsup@accentify.co.uk about content you believe violates these Terms.

Although we take reasonable steps to moderate features that contain User Content, we cannot guarantee that every inappropriate submission will be identified immediately.

8. ACCENTIFY APPROVED ACCENT COACHES

Accentify works with professional accent coaches and other specialists.

An "Accentify Approved Accent Coach" or "Triple A Accent Coach" is an independent professional approved or engaged by Accentify to provide accent coaching, feedback, course creation or related services in connection with Accentify.

Triple A Accent Coaches are freelancers or independent contractors rather than employees of Accentify.

Their relationship with Accentify depends on the service being provided.

8.1 Coaches providing an Accentify service

Where Accentify engages a Triple A Accent Coach to deliver part of a service that Accentify itself provides to you — for example, reviewing a voice submission or creating or delivering Accentify learning content — the coach acts on Accentify's behalf for the purpose of that service.

Where you submit a recording for human review, Accentify may provide the relevant recording and learning context to the Triple A Accent Coach or other professional assigned to review it.

Human accent feedback necessarily involves professional judgement. Different qualified coaches may occasionally express different views about a pronunciation, accent feature or recommended approach.

8.2 Hire A Coach

Accentify's Hire A Coach feature may help users discover and contact approved professional coaches.

Unless Accentify expressly states otherwise at the relevant time, Accentify does not process the booking or payment for coaching arranged following an introduction through Hire A Coach.

Where you and a coach arrange and pay for coaching directly with each other outside Accentify's payment systems, the resulting coaching agreement is between you and the coach, not Accentify.

Any cancellation, refund, scheduling or other terms agreed directly between you and the coach will apply to that arrangement.

A coach's status as a Triple A Accent Coach does not give that coach authority to enter into contracts, make guarantees or assume obligations on Accentify's behalf outside a service that Accentify has specifically engaged them to provide.

Accentify's approval of a coach does not guarantee a particular learning or professional outcome.

Nothing in this section excludes any responsibility Accentify has under applicable law or for a service that Accentify has expressly agreed to provide itself.

9. FREE AND PAID SERVICES

Accentify may offer free features, paid subscriptions, one-off purchases, premium tiers or other paid products.

The names, prices, availability and included features of these products may vary depending on:

  • your country or region;

  • your device;

  • the platform through which you purchase;

  • your currency;

  • taxes;

  • promotions;

  • the date of your purchase; and

  • the specific offer available to you.

The product, price, billing period and key benefits that apply to your purchase will be shown to you before you complete the transaction.

Different prices or offers may be available because of legitimate factors such as region, currency, taxation, platform pricing or promotions.

Special, historical or promotional entitlements may continue to be governed by the terms of the offer under which they were originally obtained.

10. SUBSCRIPTIONS, BILLING AND RENEWAL

10.1 Subscription purchases

Where you purchase an Accentify subscription, the billing period and renewal terms will be displayed before purchase.

Subscriptions may be sold through:

  • the Apple App Store;

  • Google Play;

  • Accentify directly;

  • Stripe; or

  • another authorised payment or distribution provider.

The provider through which you make the purchase may have its own terms and payment rules.

10.2 Automatic renewal

Where a subscription is described as automatically renewing, it will continue and you may be charged for another subscription period unless you cancel it in accordance with the cancellation process applying to that subscription.

The amount and frequency of recurring charges will be shown to you before purchase.

Your rights relating to renewal, renewal reminders, cancellation and cooling-off periods may vary depending on applicable law and the provider through which the subscription was purchased.

Nothing in these Terms removes rights you are given by applicable consumer law.

10.3 Payment

You authorise the relevant payment provider to charge the payment method associated with your purchase for amounts properly due in connection with the subscription or purchase.

Payment processing may be carried out by Apple, Google, Stripe or another provider rather than directly by Accentify.

Accentify does not receive or store your full payment-card number.

10.4 Taxes and currencies

Prices may include or be subject to applicable taxes depending on the country, platform and transaction.

Currency conversion and payment-provider charges may be determined by your bank, app store or payment provider.

10.5 Changes to subscription prices

Accentify may change the price of a subscription for future billing periods.

Where required by applicable law or the relevant payment provider, we or the payment provider will give you advance notice of a price change.

Where a price change affects a future renewal, you will have any cancellation, consent or other rights provided by applicable law or the relevant payment provider.

A price change will not retrospectively increase the price of a subscription period you have already paid for.

11. CANCELLATION AND REFUNDS

11.1 Cancelling a subscription

You can cancel a subscription through the cancellation method applicable to the platform or provider through which you purchased it.

For purchases made through Apple or Google, cancellation will normally need to be completed through the relevant app-store subscription controls.

For subscriptions purchased directly from Accentify, you may use the online cancellation method made available by Accentify or follow the current instructions in our Billing Help Centre.

Cancelling a subscription normally prevents future renewals.

Unless applicable law or your purchase provider provides otherwise, you may continue to have access to the paid subscription until the end of the period for which you have already paid.

Cancelling a subscription does not delete your Accentify account.

11.2 Refunds

Except where required by applicable law or provided under the terms of a particular purchase or promotion, payments are generally non-refundable and we do not normally provide refunds or credits for partially used subscription periods.

Refunds for purchases processed through the Apple App Store or Google Play may need to be requested through the relevant store and are subject to the store's applicable refund procedures and your legal rights.

For purchases made directly through Accentify, including eligible payments processed through Stripe, you may contact us at whatsup@accentify.co.uk.

Virtual Items are not automatically refundable merely because you no longer want them or no longer wish to use the Services. This does not affect refunds or other remedies available under applicable law or through the relevant payment provider.

11.3 Statutory cancellation rights for direct purchases

If you purchase directly from Accentify and applicable law gives you a statutory right to cancel or withdraw from the purchase, you may exercise that right in accordance with the applicable law.

Where you expressly ask Accentify to begin supplying digital content or services immediately, your statutory cancellation rights may be affected where applicable law permits this and the required information, agreement and acknowledgements have been provided to you.

Nothing in this section limits rights that cannot lawfully be excluded.

11.4 Your other statutory rights

Nothing in these Terms limits any refund, cancellation, withdrawal, cooling-off or other consumer right that you are entitled to under applicable law.

Where applicable law gives you rights that are more favourable than these Terms, the law will apply.

12. GOLD, REWARDS AND VIRTUAL ITEMS

Accentify may provide virtual items or balances including "Gold", lives, streak-related items, rewards, cosmetics, bonuses or other digital items ("Virtual Items").

Virtual Items may be:

  • earned through learning activity;

  • awarded through streaks, achievements or other features;

  • received by watching rewarded advertisements;

  • granted through promotions;

  • purchased where Accentify makes purchasing available; or

  • provided in another way described within the Services.

12.1 Virtual Items are not money

Virtual Items exist only within Accentify.

Unless Accentify expressly states otherwise, Virtual Items:

  • are not legal currency;

  • do not represent money held on your behalf;

  • do not constitute a bank or stored-value account;

  • do not earn interest;

  • have no cash value outside Accentify;

  • cannot be exchanged for cash; and

  • cannot be sold or transferred between users.

You receive a limited right to use Virtual Items within Accentify according to the rules of the relevant feature.

12.2 Virtual economy changes

Accentify may reasonably change:

  • how Virtual Items are earned;

  • what they can be used for;

  • the amount required to obtain an in-app item or benefit;

  • reward amounts;

  • item availability; and

  • other aspects of the virtual economy.

We will take account of applicable consumer law when making changes affecting Virtual Items that users have purchased with real money.

Where expiry or another important restriction applies to a purchased Virtual Item, this will be disclosed where required before purchase.

12.3 Errors, fraud and exploits

Accentify may correct a Virtual Item balance or reverse a transaction where Virtual Items were obtained or credited because of:

  • a technical error;

  • duplicate rewards;

  • a reversed or refunded payment;

  • fraud;

  • manipulation of advertising or referral systems;

  • exploitation of a bug or vulnerability;

  • unauthorised automation; or

  • another breach of these Terms.

We will not remove legitimate purchased value arbitrarily.

12.4 Rewarded advertisements

Accentify may offer users the opportunity to receive a reward for viewing or completing an advertisement.

Reward availability may depend on third-party advertising providers and is not guaranteed.

You must not manipulate, automate, falsify or otherwise interfere with advertisement views or reward events.

13. PROMOTIONS, REFERRALS AND SPECIAL OFFERS

Accentify may offer promotions, competitions, referral programmes, discounts, introductory offers or other special arrangements.

Additional Terms may apply to these offers.

Where Additional Terms are provided, they form part of your agreement with Accentify for that offer.

Accentify may refuse or reverse a promotional reward where it was obtained through fraud, duplicate accounts, manipulation, abuse of the promotion or another material breach of the applicable rules.

We will honour valid entitlements created under previous offers in accordance with the terms that applied to those offers.

14. ACCEPTABLE USE

You must use Accentify lawfully and responsibly.

You must not:

  • use the Services for illegal or fraudulent activity;

  • harass, threaten, bully or abuse other people;

  • promote hatred, discrimination or violence;

  • exploit or endanger children;

  • submit sexually exploitative or otherwise unlawful material;

  • impersonate another person or misrepresent your relationship with Accentify;

  • infringe another person's intellectual property, privacy or other rights;

  • submit content that you do not have the right to use;

  • distribute malware, malicious code or harmful links;

  • attempt to gain unauthorised access to another account, system or network;

  • attack, overload, interfere with or disrupt Accentify's systems;

  • circumvent access controls, subscription restrictions, security measures or technical protections;

  • manipulate Gold, lives, streaks, achievements, referrals, advertisements, rewards or other Accentify systems;

  • deliberately exploit bugs or vulnerabilities for an unfair advantage;

  • scrape, harvest, copy or extract Accentify data or content using bots or automated systems without our permission;

  • use automated tools to create accounts, post content or simulate user activity without our permission;

  • reverse engineer, decompile or attempt to obtain the source code or underlying proprietary technology of the Services except where applicable law expressly permits this;

  • resell or commercially redistribute access to the Services without our permission;

  • cheat or use outside assistance in an Accentify assessment where the applicable rules prohibit it;

  • interfere with another user's ability to use Accentify; or

  • encourage or assist another person to do any of the above.

Security researchers who believe they have discovered a vulnerability should report it responsibly rather than exploit it.

15. ACCENTIFY'S INTELLECTUAL PROPERTY

Accentify and its licensors own or control the intellectual property rights in the Services and Accentify-created content, including where applicable:

  • the Accentify name and branding;

  • Tify and associated character designs;

  • course content;

  • lesson structures;

  • educational materials;

  • graphics and illustrations;

  • videos and audio;

  • software and code;

  • interfaces and designs;

  • databases and compilations;

  • assessment materials;

  • proprietary speech-analysis and AI systems; and

  • other Accentify-created materials.

Subject to these Terms, Accentify grants you a limited, non-exclusive, non-transferable licence to access and use the Services for your own lawful learning, training and professional preparation.

This licence does not allow you to:

  • reproduce entire Accentify courses or substantial parts of them;

  • resell Accentify material;

  • operate a competing course or service using copied Accentify content;

  • distribute Accentify's proprietary assessment materials;

  • remove copyright, trademark or ownership notices; or

  • imply that Accentify endorses, sponsors or is affiliated with you where this is not true.

You may use Accentify's built-in sharing features and may share reasonable screenshots or excerpts for ordinary personal or social-media purposes, commentary or discussion, provided that you do not misrepresent Accentify or commercially redistribute substantial proprietary content.

No right to use Accentify's trademarks or branding commercially is granted unless we give permission.

16. CHANGES TO AND AVAILABILITY OF THE SERVICES

Accentify is an evolving product.

We may make reasonable changes to the Services for reasons including:

  • improving functionality, accessibility or usability;

  • introducing or improving technology;

  • fixing errors or technical problems;

  • improving security or preventing fraud and abuse;

  • complying with law, regulation or app-store requirements;

  • replacing technology or third-party services that are no longer reasonably suitable or available;

  • responding to changes that are outside Accentify's reasonable control; or

  • adding new products, content or features.

16.1 Free, experimental and temporary features

We may add, redesign, restrict, replace or discontinue free, beta, experimental, promotional or temporary features, provided that doing so does not unlawfully interfere with a paid entitlement you have already purchased.

16.2 Paid Services during a period you have already purchased

We will not use these Terms as a blank cheque to materially reduce the core paid Service that you have already purchased without appropriate justification.

Where we make a change that materially reduces an important element of a paid Service during a period you have already paid for, we will provide reasonable notice where practicable and take reasonable steps to avoid materially disadvantaging you.

Depending on the circumstances, this may include:

  • maintaining access for the remainder of the paid period;

  • providing a reasonably suitable alternative;

  • allowing cancellation; or

  • providing an appropriate proportionate refund or other remedy.

A change required urgently for security, legal, regulatory or technical reasons may sometimes need to take effect without advance notice.

Nothing in this section limits any remedy required by applicable consumer law.

16.3 Future subscription periods

Features, plans and benefits available for future subscription periods may change.

Material changes affecting renewal will be communicated where required by applicable law or the relevant payment provider, and you will have any cancellation or other rights that apply.

16.4 Availability

We do not guarantee that the Services will be available without interruption.

Maintenance, internet problems, third-party outages, security incidents, updates or circumstances outside Accentify's reasonable control may occasionally interrupt access.

Where reasonably possible, we will seek to minimise disruption.

If Accentify permanently discontinues a paid Service during a period for which you have already paid and does not provide a reasonably suitable alternative, we will provide any refund or other remedy required by applicable law.

17. SUSPENSION AND TERMINATION

17.1 Action we may take

Accentify may warn, restrict, suspend or terminate access to an account where reasonably necessary because:

  • you materially or repeatedly breach these Terms;

  • your account is involved in fraud, abuse or unlawful activity;

  • you threaten the security or integrity of the Services;

  • you seriously abuse another user, coach or member of Accentify's team;

  • you manipulate payments, subscriptions, advertisements or Virtual Items;

  • payment properly due to Accentify has not been made;

  • we are required to act by law, a court, regulator or platform provider; or

  • immediate action is reasonably necessary to protect users, Accentify or another person.

Where appropriate, we may give you notice and an opportunity to correct a breach before permanently terminating your account.

Serious fraud, security threats, unlawful conduct or other urgent circumstances may require immediate action.

17.2 Effect on paid access

If we permanently terminate your account because of a serious or repeated breach of these Terms, you may lose access to paid features without a refund to the extent permitted by applicable law.

If Accentify permanently terminates a paid Service without breach by you, we will provide any refund or other remedy required by applicable law.

If Accentify permanently terminates your account, we will stop future renewal of any subscription that is billed directly by Accentify.

Subscriptions purchased through third parties such as Apple or Google may need to be cancelled separately through that provider.

18. ACCOUNT DELETION

You may permanently delete your Accentify account using the Delete Account feature provided in the Accentify app.

If you no longer have access to the app, you may request deletion through Accentify's Data Deletion page:

Account deletion is intended to be permanent.

You may lose access to learning progress, account history, User Content, Virtual Items and other account-linked information.

The deletion of personal information associated with your account is handled in accordance with our Privacy Policy.

Limited information may be retained where required or permitted by law, including for financial records, fraud prevention, dispute resolution or legal claims.

We may take reasonable steps to verify that a deletion request has been made by or on behalf of the account holder.

18.1 Direct Accentify subscriptions

If you permanently delete your account, Accentify will stop future renewal of any recurring subscription billed directly by Accentify that we can identify as belonging to that account.

Deleting your account does not automatically create a refund for a subscription period already paid for, except where applicable law provides otherwise.

18.2 Apple, Google and other third-party subscriptions

Deleting your Accentify account does not necessarily cancel a subscription billed by a third party.

This is particularly important where your subscription is billed by Apple, Google or another external provider.

If you do not want future renewal charges, you should cancel the subscription through the relevant provider or purchase method.

Likewise, cancelling a subscription does not by itself delete your Accentify account.

Third-party payment providers may retain their own transaction records independently of Accentify.

19. THIRD-PARTY SERVICES AND APP STORES

Parts of Accentify rely on services supplied by third parties.

These may include app stores, payment processors, authentication providers, cloud infrastructure, customer-support services, analytics providers, advertising providers, AI providers and speech-processing technology.

Your use of a third-party service may also be governed by that provider's terms.

Accentify is not responsible for the operation of a third-party service outside Accentify's reasonable control, although this does not affect any responsibility Accentify has under applicable law.

19.1 Apple App Store

If you obtain the Accentify application through Apple's App Store, your use of the application is also subject to Apple's applicable App Store terms and Apple's Standard Licensed Application End User License Agreement, where applicable.

Apple may also process App Store purchases, subscriptions and refunds in accordance with its applicable terms.

These Terms govern your relationship with Accentify in relation to the Accentify Services.

19.2 Google Play

If you obtain Accentify through Google Play, your use of Google Play and transactions processed through Google may also be governed by Google's applicable terms.

Google may process purchases, subscriptions and refunds made through Google Play.

These Terms govern your relationship with Accentify in relation to the Accentify Services.

20. ACCENTIFY EXAMINATIONS AND ASSESSMENTS

Accentify may offer formal accent examinations, assessments and certificates.

Accentify Examinations may be subject to separate Accentify Examination Terms presented before booking.

These Additional Terms may govern matters including:

  • eligibility;

  • booking;

  • fees;

  • cancellation and rescheduling;

  • technical requirements;

  • examination conditions;

  • conduct and outside assistance;

  • grading;

  • examiner discretion;

  • resits;

  • reviews or appeals;

  • results; and

  • certification.

The price of an examination will be displayed at the time of booking and may change over time.

Accentify examination results represent Accentify's assessment of a person's performance against Accentify's applicable accent criteria.

Unless Accentify expressly states otherwise, an Accentify certificate is not a government-regulated academic qualification, university accreditation, immigration qualification or externally regulated professional certification.

A certificate does not guarantee employment, casting, admission to an institution or acceptance by a third party.

Where the Accentify Examination Terms conflict with these Terms regarding an examination, the Examination Terms will take priority for that examination.

21. LEARNING OUTCOMES AND PROFESSIONAL RESULTS

Accentify is designed to help users learn, practise and develop accent and speech skills.

Individual results vary.

Progress may depend on factors including:

  • existing speech patterns;

  • practice frequency;

  • learning method;

  • the target accent;

  • individual ability;

  • feedback followed;

  • equipment and recording quality; and

  • other circumstances.

Accentify does not guarantee that you will:

  • master an accent;

  • become indistinguishable from a native speaker;

  • achieve a particular Accentify score;

  • pass an examination;

  • obtain acting or voiceover work;

  • succeed in an audition;

  • obtain employment;

  • achieve a particular professional result; or

  • receive a particular response from a casting director, employer, educational institution or another third party.

Accent coaching and Accentify's speech-analysis tools are educational services.

Unless expressly stated otherwise, they are not speech and language therapy, medical treatment, diagnosis or healthcare.

Nothing in this section removes any obligation Accentify has to provide paid Services with the standard of care or quality required by applicable law.

22. YOUR CONSUMER RIGHTS

Nothing in these Terms is intended to exclude, restrict or reduce rights that cannot lawfully be excluded.

If you are a consumer, applicable law may give you rights relating to matters such as:

  • digital content;

  • services;

  • reasonable care and skill;

  • conformity with description;

  • subscription renewal;

  • cancellation;

  • refunds;

  • unfair contract terms; and

  • remedies when a service is not provided correctly.

These statutory rights apply in addition to these Terms.

Where a provision of these Terms conflicts with a mandatory consumer right that applies to you, the mandatory right will take priority.

23. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;

  • fraud or fraudulent misrepresentation; or

  • any other liability that applicable law does not permit us to exclude.

23.1 Consumers

If you are using Accentify as a consumer, Accentify is responsible for losses that are a foreseeable result of Accentify breaching these Terms or failing to use reasonable care and skill where the law requires us to do so.

We are not responsible for losses that could not reasonably have been foreseen when you entered into the relevant agreement with us.

We are also not responsible for loss caused by circumstances for which Accentify is not legally responsible, including where the loss results solely from:

  • your own breach of these Terms;

  • incompatible or faulty equipment controlled by you;

  • your internet or mobile connection;

  • an unauthorised third-party service; or

  • information or content you chose to provide unlawfully.

This does not affect rights you have under consumer law.

23.2 Business or professional use

If you use Accentify wholly or mainly for the purposes of your trade, business or profession, then to the extent permitted by law Accentify will not be responsible for:

  • loss of profit;

  • loss of revenue;

  • loss of business;

  • loss of anticipated savings;

  • loss of opportunity;

  • loss of goodwill; or

  • indirect or consequential business loss.

Subject to the liabilities that cannot lawfully be excluded, Accentify's total aggregate liability to you arising out of or in connection with the Services will, to the extent permitted by law, not exceed the greater of £100 or the total amount you paid directly to Accentify for the Services during the 12 months immediately preceding the event giving rise to the claim.

Nothing in this section excludes liability that cannot lawfully be excluded.

Separate commercial, educational or institutional agreements may contain different liability terms.

24. CHANGES TO THESE TERMS

Accentify may update these Terms from time to time.

Reasons may include:

  • changes to the Services;

  • new features;

  • changes to payment or subscription systems;

  • changes in technology;

  • changes to law or regulation;

  • changes required by app stores or other platforms;

  • security or fraud-prevention measures; or

  • making the Terms clearer.

When we update these Terms, we will update the "Last updated" date.

Where a change is material, we will provide reasonable notice where appropriate, for example through the Services, by email or through another suitable method.

The notice will explain when the updated Terms take effect and, where appropriate, what action you need to take.

We will not use changes to these Terms to retrospectively remove rights you have already accrued where doing so would be unlawful or unfair.

Where applicable law requires your agreement to a particular change, we will obtain it.

Where a material change adversely affects an ongoing paid Service, you will have any cancellation or other rights provided by these Terms and applicable law.

25. GOVERNING LAW, COMPLAINTS AND DISPUTES

These Terms and your relationship with Accentify are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the country where you live.

If you are a consumer living outside England and Wales, you may benefit from mandatory rights under the laws of your country that these Terms cannot remove.

Nothing in these Terms prevents you from bringing a claim in a court that applicable consumer law gives you the right to use.

Before beginning formal legal proceedings, we encourage you to contact us at whatsup@accentify.co.uk so that we can try to resolve the issue.

If we are unable to resolve a consumer complaint, we will provide information about any alternative dispute resolution arrangements that we are required or have agreed to use, where applicable.

26. GENERAL TERMS

26.1 Entire agreement

These Terms, any applicable Additional Terms and any terms specifically presented in connection with a particular purchase form the agreement between you and Accentify regarding the relevant Services.

Our Privacy Policy explains how Accentify processes personal information and should be read alongside these Terms. It is not intended to replace or reduce rights or obligations arising under applicable data-protection law.

26.2 Priority

Where terms forming part of your agreement with Accentify conflict:

  1. terms specifically agreed for a particular purchase, feature or service will apply to that matter;

  2. applicable Additional Terms will apply to the feature they govern; and

  3. these Terms will otherwise apply.

The Privacy Policy governs Accentify's handling of personal information.

26.3 Transfer

You may not transfer your rights under these Terms to another person without our permission unless applicable law gives you the right to do so.

Accentify may transfer its rights or obligations to another organisation as part of a merger, acquisition, restructuring, sale of business or similar transaction, provided that doing so does not unlawfully reduce your rights.

26.4 Severability

If a court or competent authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

26.5 No waiver

If Accentify does not immediately enforce a provision of these Terms, that does not mean we permanently give up the right to enforce it.

26.6 No rights for unrelated third parties

Except where applicable law or Additional Terms expressly provide otherwise, a person who is not a party to these Terms does not have a right to enforce them.
